1. Agreement to Terms
By accessing or using the Fernline website at https://fernlinehq.com or any of our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
2. Description of Services
Fernline provides AI voice agent services, website development, Google Business Profile management, and business automation services to home service businesses. Our services are provided on a monthly basis unless otherwise agreed in writing.
3. Eligibility
You must be at least 18 years old and have the authority to enter into binding agreements on behalf of your business to use our services.
4. Account and Access
If we provide you with access credentials for dashboards or other tools, you are responsible for maintaining the confidentiality of those credentials and all activities under your account.
5. Service Terms
Voice Agent Services
- Voice agents are configured based on information you provide about your business processes
- You are responsible for ensuring the accuracy of business information, hours, and booking rules
- We do not guarantee that voice agents will correctly handle every call scenario
- Call forwarding setup is your responsibility, following our instructions
Website Services
- Websites remain hosted as long as your service is active
- Content provided by you must not violate any laws or third-party rights
- We retain ownership of the underlying code; you own the content
6. Payment Terms
- Services are billed monthly in advance unless otherwise agreed
- Payments are due upon receipt of invoice
- Late payments may result in suspension of services after 14 days notice
- Prices may change with 30 days notice
7. Cancellation
You may cancel services at any time by notifying us in writing (email is sufficient). Upon cancellation:
- Voice agent services will be disabled
- Call forwarding should be removed from your phone system (we will assist)
- Website hosting will end at the end of the paid period
- We will provide data export within 30 days upon request
No refunds are provided for partial months, except at our discretion.
8. Intellectual Property
Fernline owns all rights to our technology, code, processes, and methods. You retain ownership of your business information, content, and customer data. You grant us a license to use your information solely to provide the services.
9. Confidentiality
We treat your business information and customer data as confidential. We will not share this information except as described in our Privacy Policy or as required by law.
10. Limitation of Liability
To the maximum extent permitted by law, Fernline's liability for any claims arising from or related to our services is limited to the amount paid by you in the 3 months preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption.
11. Disclaimer of Warranties
Our services are provided "as is" without warranties of any kind, express or implied. We do not warrant that services will be uninterrupted, error-free, or that voice agents will correctly handle all call scenarios.
12. Indemnification
You agree to indemnify and hold Fernline harmless from claims arising from your use of our services, your violation of these terms, or your violation of any rights of another party.
13. Governing Law
These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.
14. Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email or by posting notice on our website. Continued use of services after changes constitutes acceptance.
